Rules and Regulations

The walkways, driveways and stairways shall not be obstructed or used for any purpose other than ingress and egress from the apartments.

The exterior of the Apartments and the building and all other areas appurtenant to an apartment shall not be painted, decorated or modified by any apartment owner in any manner without the prior written consent of the Association by its Board, which consent may be withheld on purely aesthetic grounds within the sole discretion of the board.

No article shall be hung or shaken from the walkways, doors, windows, or balconies of the apartments or placed upon the outside window sills of the apartments.

No bicycle scooters, baby carriages or similar vehicles or toys or other personal articles shall be allowed to stand in any common areas except in areas specifically designated for such purposes.

No apartment owner shall make or permit any noises that will disturb or annoy the occupants of any of the apartments or do or permit anything to be done which will interfere with the rights , comfort or convenience other apartment owners. The Board may require an apartment owner to carpet or place area rugs in the bedroom, living room and/or dining room areas of an apartment in order to curtail noise disturbing other apartment owners.

Each apartment owner shall keep his apartment in a good state of preservation and cleanliness and shall not sweep or throw or permit to be swept or thrown from the doors windows or balconies thereof, any dirt or other substance.

There shall be a $20.00 lockout charge if the association is requested to furnish keys for access to an apartment owner who has locked himself out of his apartment. There shall be a $30.00 charge if the association is required to furnish a new set of keys to an owner who has lost his keys.

Each apartment owner who plans to be absent from his apartment during the hurricane season must prepare his apartment prior to his departure by:

Removing all furniture, potted plants and other moveable objects from his terrace or balcony, if any, and

Designation of a responsible firm or individual satisfactory to the association to care for his apartment should the apartment suffer hurricane damage. Such firm or individual shall contact the Association for entrance to install or remove hurricane shutters.

All garbage and refuse from the apartments shall be deposited with care in the receptacles intended for such purpose only at such times and in such manner as the association will direct. All disposals shall be used in accordance with instructions given to the apartment owner by the association.

Water closets and other water apparatus in the apartments or upon the condominium property shall not be used for any purpose other than those for which they were constructed. Any damage resulting from usage of any water closets or other apparatus shall be paid for by the apartment owner responsible for same.

No apartment owner shall request or cause any employee or agent of the Association to do any private business of the apartment owner, except as shall been approved in writing by the Association.

The agents and employees of the Association, if any, and all contractor or workman authorized by the Association may enter any apartment at any reasonable hour of the day for the purposes permitted under the terms of the Condominium Documents. Entry will be made by per arrangement with the apartment owner, except under circumstances deemed an emergency by the Association manager, in which case, access is deemed permitted regardless of the hour.

No motor vehicle or other possessions belonging to an apartment owner or to a member of the family or guest, tenant or employee of an apartment owner shall be positioned in such a manner as to impede or prevent ready access to another apartment owner’s parking space. The apartment owners, their families, employees, servants, agents, visitors and licensees will obey the posted parking regulations and any other traffic regulations promulgated in the future of the safety, comfort and convenience of the apartment owners. No self-powered vehicle, which cannot operate on its own, shall remain on the condominium property for more than twenty-four hours and no repair of vehicles shall be made on the condominium property. Recreational vehicles and boat trailers will only be permitted in such places as may be specifically assigned for such use by the Association.

Except for an emergency, apartment owners shall not cause or permit the blowing of any horn from any vehicle of which he, his guest or family shall be occupants.

No apartment owner shall use or permit to be brought into any apartment any inflammable oils or liquids such as gasoline, kerosene, naphtha or benzene, or other explosives or articles deemed extra hazardous to life, limb or property.

The association may retain a pass key to each apartment. No apartment owner shall install any lock or install a new lock on any door leading into his apartment with out the prior written consent of the association. If such consent is given, the apartment owner shall provide the Association with a key for the use of the Association and the Board.

Any damage to the Condominium property or equipment of the Association caused by any apartment owner, or his family members, guests or invitees shall be repaired or replaced at the expense of the apartment owner.

Apartment owner shall be held responsible for the actions of their children and their guests, licensees and invitees.

Apartment owners shall not be allowed to put their names on any entry of the apartments or mail receptacles appurtenant thereto, except in the proper places and in the manner prescribed by the Association for such purposes.

Food and beverage may not be prepared or consumed on the condominium property, except in the apartments and in accordance with regulations which may be promulgated from time to time by the Association.

Complaints regarding the management of the apartments and grounds or regarding actions of other apartment owners shall be made in writing to the Association.

Any consent or approval given under these rules and regulations by the Association shall be revocable at any time by the Board.

The swimming pool and any other recreational facilities which may be added are solely for the use of the apartment owners, their family members, lessees and invited guests. The use of recreational facilities shall be at the risk of those involved and not, in any event, the risk of the Association or its manager, if any.

The regulations governing the use of the recreational facilities including permitted hours, guest rules, safety and sanitary provisions and all other pertinent matters shall be in accordance with regulations adopted from time to time by the Association and posted in the appropriate recreational areas.

No pets such as dogs and the like shall be permitted in the apartments. Owners may have two indoor cats.

Apartment owners are referred to the Occupancy and Use Restrictions contained in Article XII of the Declaration of Condominium which are binding upon all apartment owners.

No awnings, curtains, shades, window guards, light reflective materials, hurricane or storm shutters, ventilators, fans or air-conditioning devices shall be attached or affixed to the exterior of or be used in or about an apartment except as shall have been approved in writing by the Association which approval may be withheld on purely aesthetic grounds within the sole discretion of the Association.

No sign, notice or advertisement shall be inscribed or exposed on or at any window or other part of an apartment which is in view of the public, nor shall anything be projected out of any window of an apartment, except such as shall have been approved in writing by the Association.

No radio or television aerial or antenna shall be attached to or hung from the exterior of any apartment or the roof of the condominium.

Liability for any damage to the condominium property caused by the moving or carrying of any article on the condominium property shall be borne by the apartment owner responsible for the presence of such article.

These rules and regulations may be modified, added to or repealed at any time by the Association.
The below Rules and Regulations were instituted and passed June 29, 1996 by a duly called meeting of the Pompano Courts Condominium Association Board of Directors.

Fines Concerning Violations of Condominium Rules: Owners will be notified by phone and/or letter of any violations. Each owner will be given two weeks to correct the violations. If the violation is not corrected by the 14th day of the violation, a $10.00 a day fine will be levied upon the owner until the violation is corrected. Failure to pay the fine and correct the violation will result in legal action and all fees involved in that action to be borne by the owner. If a renter is in violation and the owner attempts, unsuccessfully, to correct the problem and is in the process of eviction, the officers have the authority to waive the fines upon presentation of eviction papers and then only if the eviction leads to a successful conclusion and correction of the violation, In all situations involving fees for violations, the officers of the Association have discretionary power to levy or relieve fines.
Late Maintenance Fines: A fine of $25.00 will be levied on any owner who is late in the paying of maintenance fees. The fine to be levied will be effective the 15th of the month and every month thereafter until the total maintenance and late fees owed are paid in full. The failure of the owner to pay the maintenance or late fees will result in a lien and a possible foreclosure action upon the property.
Boat Trailers and Recreational Vehicles: It will be allowed for owners and renters to park boat trailers, recreational vehicles and traditional pick up trucks in the parking lots of the property in areas designated by the officers of the Association.
Occupancy: The following definition is adopted as a by-law of the association with regard to occupancy, XII-A as defined in the Declaration of Condominium. A single family is considered a single person or a couple. All other persons must be considered a guest and must follow the visitation guidelines specified by the condo rules and regulations. All owners and renters will from this date forward be subject to a complete application and background screening to be done by the association board. This process must be completed and the renter or owner approved by the association prior to occupancy. The officers of the association have the authority to exclude anyone from occupancy for cause.
Visitation: The unit owner or tenant must inform the Association of any guest that will be visiting for more than three nights. No guests may stay for periods longer than one week without Association written approval. All guests must use the resident’s guest parking pass while parked on the property.

Parking: All residents shall be issued a parking decal by the Association. All residents must have an authorized parking decal displayed on the bottom left corner of the vehicle’s windshield. All guests must have an authorized parking permit displayed on the dashboard while parked on the property after 9:00PM. The Association is authorized to tow or otherwise have removed any unauthorized vehicles or vehicles not displaying a parking permit as required, while parked on the property. In addition, Residents may be fined $25 for each violation and for each of their guest violations.

Addendum:

No items of any type are permitted on walkways. Walkways are defined as any concrete walks within 3 feet of the building walls. This includes any tables, chairs, potted plants, etc. which would obstruct a clear path.

Nothing is permitted in any planting areas except plants. These areas include all areas next to the building walls, that are unpaved.

Grilles are permitted only along the southern end of the patio areas.

No items are permitted within 6 feet of the swimming pool ever. There can be no items between the pool deck and the building walls.

All hoses, except for the two hoses reels on the patios must be removed.
-
Any damaged or unsafe chairs and tables will be disposed of.
-
Any pool toys must be removed and/or kept inside.

Any bicycles, exercise equipment or similar items must be removed or kept in the units.

Nothing may be attached to the building without permission. This includes satellite dishes, hanging plants, etc

Trash cans in laundry rooms are to be used only for dryer lint. Remove and dispose of any empty bottles, boxes, etc. in the dumpster at the western end of the property.

No household trash is to be placed in the laundry trash cans.

Any outdoor furniture that is moved must be returned to its original position.
